Program Name: Zero Light SMS Alerts

These terms govern your participation in Zero Light's SMS/text messaging program. By opting in, you agree to these terms.

 

1. Program Description

Zero Light offers an SMS messaging program that sends automated marketing and transactional text messages to subscribers.

Message Types:

Marketing Messages (require consent):

  • Welcome messages for new subscribers
  • Abandoned cart reminders
  • Abandoned checkout notifications
  • Exclusive promotional offers
  • New product launches
  • Flash sales and discount codes
  • VIP early access alerts

Transactional Messages (no consent required):

  • Order confirmations
  • Payment receipts
  • Shipping notifications
  • Delivery updates
  • Return/exchange status
  • Customer service responses

You may receive both types if you consent to marketing messages.

2. How to Opt In

At Checkout or Account Creation:

Check the SMS consent box and provide your mobile phone number:

"☐ Yes, send me text messages about my order and exclusive offers. By checking this box, I agree to receive automated marketing texts from Zero Light at the number provided. Consent is not required to make a purchase. Msg & data rates may apply. Msg frequency varies. Reply STOP to cancel, HELP for help."

Text-to-Join (if we offer this in future):

Text START, JOIN, or YES to our short code. You'll receive a confirmation message.

By Opting In You Confirm:

  • You are the mobile account holder or have authorization to opt in this number
  • You are at least 18 years old
  • You consent to receive automated marketing texts using an automatic telephone dialing system
  • You understand consent is not required to make a purchase

3. Message Frequency

Marketing Messages: Up to 4 messages per month (may increase during sales periods)

Transactional Messages: Sent as needed based on your order activity (typically 3-6 per order)

Total Combined: Variable, depends on your orders and promotional activity

Message frequency may vary. During major sales events (Black Friday, seasonal promotions), you may receive additional messages.


4. Message & Data Rates

Standard messaging and data rates may apply based on your mobile carrier plan.

Zero Light does not charge for messages, but your carrier may. Messages count against your SMS plan allowance. Contact your carrier for pricing details.

Data Usage: SMS messages use minimal data. MMS messages (containing images/links) may use more data.

5. How to Opt Out

Stop Marketing Messages

Reply STOP to any marketing message from Zero Light.

You'll receive one final confirmation message: "Zero Light: You're unsubscribed from marketing texts. You may still receive order updates. Reply START to resubscribe or contact support@zerolight.store"

Processing Time: Opt-out requests are processed within 5 seconds for our systems. Allow up to 24 hours for complete removal from all campaigns.

Effect: Stops marketing messages only. You'll still receive transactional messages (order confirmations, shipping updates) for active orders.

Other Opt-Out Methods:

  • Email support@zerolight.store with "SMS UNSUBSCRIBE" and your phone number
  • Update preferences in your account settings at zerolight.store
  • Click unsubscribe link in any text message (if provided)

Stop All Messages

To stop all messages including order updates, email support@zerolight.store with "STOP ALL SMS" and your phone number. Note: This may affect your ability to receive critical order information.

6. How to Get Help

Reply HELP to any message from Zero Light.

You'll receive: "Zero Light: Need help? Contact support@zerolight.store or visit zerolight.store/help. Msg&data rates may apply. Reply STOP to cancel."

7. Supported Carriers

This service is available on the following US carriers:

Major Carriers: AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Virgin Mobile

Regional & MVNO Carriers: Cricket Wireless, Google Fi (Project Fi), Xfinity Mobile, Consumer Cellular, Spectrum Mobile, Visible, Mint Mobile, Simple Mobile, TracFone, Straight Talk, Net10, Total Wireless, Page Plus, Ting, Republic Wireless, FreedomPop, RedPocket, Ultra Mobile, Lycamobile, H2O Wireless, GoodTalk, Affinity Cellular

Carrier Coverage Subject to Change: Carriers may be added or removed without notice. We are not responsible if your carrier is not supported or blocks our messages.

8. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery depends on:

  • Network coverage and capacity
  • Your device compatibility
  • Account status with your carrier
  • Carrier filtering/blocking policies

We use commercially reasonable efforts to deliver messages but cannot guarantee delivery, timeliness, or accuracy.

9. SMS Service Provider

We use Omnisend to deliver text messages.

By subscribing, you authorize Zero Light to share your mobile phone number, consent status, message interaction data, and shopping behavior with Omnisend for message delivery, personalization, and compliance purposes.

Omnisend's Role:

  • Acts as a data processor on our behalf
  • Provides message delivery infrastructure
  • Maintains compliance with telecommunications regulations
  • Stores consent records and opt-out requests
  • Processes message engagement analytics

Data Shared with Omnisend:

  • Your mobile phone number
  • Your name and email address (if provided)
  • Opt-in/opt-out timestamps
  • Order history and cart activity
  • Message delivery and engagement metrics
  • Device and browser information

Omnisend Data Processing: Omnisend is a US-based company (with servers in the US and EU) and complies with GDPR, TCPA, and other applicable data protection regulations. For international data transfer safeguards, see Omnisend's privacy policy.

10. Privacy & Data Use

Information We Collect:

  • Mobile phone number
  • Opt-in timestamp and IP address
  • Consent method (checkout, text-to-join, etc.)
  • Message delivery status (sent, delivered, failed)
  • Link clicks and engagement data
  • Opt-out requests and timestamps
  • Shopping behavior (carts, purchases, browsing)

How We Use It:

  • Send messages you've consented to receive
  • Personalize message content based on your activity
  • Track delivery and engagement for service improvement
  • Comply with TCPA and telecommunications regulations
  • Prevent fraud and abuse
  • Maintain suppression lists (opt-outs)

Retention: We retain consent records for 4 years minimum (TCPA compliance). Phone numbers on suppression lists retained indefinitely to honor opt-outs.

Data Processing Location: Your SMS data is processed by Omnisend in the United States and may be stored on servers in the US or EU.

11. TCPA Compliance

This program complies with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and related FCC regulations.

Automated Technology: We use an automatic telephone dialing system (ATDS) or prerecorded/artificial voice technology to send messages through Omnisend's platform.

Your Consent: By opting in, you provide "prior express written consent" as defined by TCPA to receive autodialed marketing messages.

California Residents: This program complies with California's Business & Professions Code § 17529.5. You consent to receive commercial text messages using automated technology.

Revocation: You may revoke consent at any time by texting STOP or using other opt-out methods described above.

12. No Purchase Necessary

Consent is not a condition of purchase. You can buy from Zero Light without subscribing to SMS messages.

  • Follow us on social media
  • Visit zerolight.store regularly
  • Create an account to save preferences

13. Age Requirement

You must be at least 18 years old to subscribe. By opting in, you confirm you meet this requirement.

14. International Numbers

This service is designed for US and Canadian mobile numbers only.

International Numbers: We do not support numbers outside US/Canada. If you provide an international number:

  • Messages may not deliver
  • You may incur high international SMS rates
  • Opt-out commands may not function

If you travel internationally, SMS delivery is not guaranteed. Contact your carrier about international roaming rates.

15. Content & Links

Message Content: Messages may contain:

  • Text-only content
  • Links to our website or specific products
  • Images (MMS messages)
  • Promotional codes
  • Personalized product recommendations

Link Safety: Links direct to zerolight.store or authorized partner sites. Never click links in messages claiming to be from Zero Light if they look suspicious. Forward to support@zerolight.store for verification.

Promotional Codes: Codes are subject to terms stated in the message and on our website. Expiration dates apply.

Personalization: Omnisend may personalize message content based on your browsing history, cart contents, and past purchases to make offers more relevant to you.

16. Service Changes & Termination

We May:

  • Modify message frequency or content types
  • Add or remove supported carriers
  • Suspend or terminate the program entirely
  • Change SMS providers (migrate from Omnisend to another platform)

Notice: Material changes will be posted here with updated "Last Updated" date. Continued participation after changes means you accept new terms.

Program Termination: If we discontinue SMS services, you'll receive one final message with confirmation. No refunds for unused "credits" or future messages as the service is free.

Provider Change: If we migrate from Omnisend to another SMS platform, your consent and opt-out preferences will be transferred. You'll receive notice and can opt out if you don't wish to continue.

17. Prohibited Use

You May Not:

  • Provide someone else's number without authorization
  • Use SMS for illegal purposes
  • Share or resell messages or promotional codes against our Terms of Service
  • Attempt to hack, spam, or abuse the messaging system
  • Use automated systems to interact with our SMS program

Violation Consequences: Account suspension, SMS unsubscription, legal action if applicable.

18. Limitations & Disclaimers

NO WARRANTIES: SMS service provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement.

NO GUARANTEE: We don't guarantee:

  • Message delivery or timeliness
  • Continuous uninterrupted service
  • Accuracy of all message content
  • Compatibility with all devices
  • Omnisend platform uptime or availability

TECHNICAL ISSUES: We're not liable for:

  • Carrier delays, outages, or blocking
  • Device compatibility problems
  • Lost messages due to network issues
  • Incorrect information in messages (though we use reasonable care)
  • Omnisend platform outages or technical failures

THIRD-PARTY DISCLAIMER: While we use Omnisend as our provider, we are not responsible for Omnisend's platform failures, data breaches, or service interruptions. Omnisend's own terms and privacy policy govern their services.

19. Limitation of Liability

MAXIMUM LIABILITY: Zero Light's total liability for SMS program issues is limited to £50 or the value of your most recent order, whichever is less.

EXCLUDED DAMAGES: We are not liable for indirect, incidental, consequential, special, or punitive damages including:

  • Lost profits or revenue
  • Business interruption
  • Missed promotional opportunities
  • Emotional distress
  • Data breaches by Omnisend (governed by their terms)

EXCEPTIONS: This limitation doesn't apply where prohibited by law. Nothing limits liability for death, personal injury, fraud, or gross negligence.

20. Dispute Resolution

Governing Law: These SMS Terms are governed by the laws of England and Wales (for our entity) and comply with US TCPA regulations (for recipients).

Informal Resolution: Before legal action, contact support@zerolight.store to resolve disputes informally. We'll respond within 10 business days.

Arbitration (US Customers):

Binding Arbitration: Disputes will be resolved through binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules.

No Class Actions: You agree to arbitrate disputes individually, not as part of a class action or representative proceeding.

Small Claims Exception: Either party may bring an individual action in small claims court.

30-Day Opt-Out: You may opt out of arbitration by emailing arbitration-opt-out@zerolight.store within 30 days of first subscribing to SMS. Include your name, phone number, and statement: "I opt out of SMS Terms arbitration."

UK/EU Customers: You may bring disputes in courts of England and Wales or your local jurisdiction.

21. Severability

If any provision is found unenforceable, the remainder of these terms continues in effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

22. Entire Agreement

These SMS Terms, together with our Privacy Policy and Terms of Service, constitute the entire agreement regarding our SMS program.

If conflicts exist:

  1. SMS Terms control for text messaging specifically
  2. Privacy Policy controls for data protection
  3. Terms of Service control for general website use
